Liability
Limitation
ChalkHill Systems do not accept responsibility
under any circumstances, accidental or otherwise for any
data lost, programme or data corruption including but not
limited to operating systems, personal data and application
programmes occurring during the process of any repair or
upgrade.
ChalkHill Systems will not accept any
liability in respect of any working time or trade lost as
a result of a breakdown of equipment or repair or work undertaken
for the client.
Pricing
Prices on this website are shown as a guide
only, please confirm pricing when ordering. All goods are
subject to availability and specifications are subject to
change without notice. Minor specification changes do not
entitle the purchaser to not proceed with an order/contract.
Payment
Business cheques without guarantee will
take four days to clear. A charge will be levied if express
clearance is required. If credit facilities have been agreed,
thirty days is the maximum period before interest charges
will be charged (3% above Lloyds TSB base rate).
Quotations
ChalkHill Systems shall not be bound by
any quotation unless confirmed in writing. Discounts will
only apply if agreed in writing by ChalkHill Systems.
Supply of Goods
Goods are not supplied on a trial basis.
Compatibility or suitability for the purpose should be checked
prior to purchase.
Goods Delivered
The customer shall inspect the goods immediately
upon delivery/ arrival. Notice in writing must be given within
three days of acceptance of the goods, in respect of any
alleged fault, incomplete or damaged product. Failure to
give such notice will deem the customer to be bound by normal
contract terms and be liable to pay for the same accordingly.
Returns/Credit
Goods may not be returned except by prior
agreement with ChalkHill Systems and for which a handling
charge will be made.
Call out or Repair Payment
Call out or repair payment is to be made
when the representative of ChalkHill Systems has decided
one of the following: -
a) The task has been completed to the requirements
specified by the customer.
b) The task is not economical to complete.
c) The task can not be completed due to
missing components / software supplied by customer.
d) The task can not be completed on site
and must be completed at the workshop.
When the ChalkHill Systems representative
has decided on one of the above, payment must be made in
full. All payments will include the hourly rate specified
plus VAT and all time taken to travel to and from the customers
site plus any parts required. Interest will be added to any
outstanding account. Due to the nature of computer configuration
all work undertaken is on an hourly rate basis. If a recall
is required / requested, even if the customer is of the opinion
the task should have been completed on a previous visit,
the visit will be chargeable at the normal hourly rate.
Computer Upgrades
In the event of computer upgrades and repairs,
ChalkHill Systems retain the possession of the customers
parts that have been replaced, unless specifically otherwise
agreed.
Warranty
All goods except mice, joysticks, keyboards
and spare / replacement parts are supplied with a one year
warranty. Customers must use any manufacturers warranty arrangements
where specifically provided. Some goods may need to be returned
to the manufacturer for diagnosis / repair / replacement.
Under these circumstances ChalkHill Systems will use its
best endeavours to ensure a reasonable repair period but
will not be held responsible for any delay beyond its control.
We may replace the goods or defective part with a refurbished
or repaired item which should be of similar but not necessarily
the same specification. Goods are not sold on a trial basis.
It is the customer's responsibility to check specifications
and compatibility before ordering. ChalkHill Systems does
not warranty the suitability and compatibility of goods for
specific applications.There is no money back guarantee for
goods ordered in error or to goods which are not returned
in ‘as new' condition. If ChalkHill agree to restocking,
a fee of at least 20% will be levied and the original plus
any other carriage is not refundable. No opened software
can be returned for credit. Faulty discs will be exchanged
by the manufacturer. These Terms and Conditions are applicable
to all ChalkHill Systems work and supply of goods unless
by written agreement of one of the partners or authorised
employees. They do not effect any consumer statutory rights.
Ownership
All parts supplied by ChalkHill Systems
remain the property of ChalkHill Systems until payment is
received in full. Spare / replacement parts have a ninety
day warranty, computer systems have a one year return to
base warranty unless otherwise stated, even if on-site installation
has been purchased.
Discretion
Clause
If ChalkHill Systems, at their discretion, vary from these terms and conditions
to the benefit of the customer, this will not be deemed to set a precedent
for these terms and conditions to be changed in relation to any other transaction.
Valid Claim
Limitation
Should there be any valid claim (by law) against ChalkHill Systems, on no account
or under any circumstances can this exceed the value of the goods supplied.
ChalkHill Systems reserve the right to change their Terms and Conditions and/or
hourly rate.
CONSUMER PROTECTION (DISTANCE SELLING)
REGULATIONS 2000
Notice is hereby given that under the above
regulations consumers are allowed a "cooling off" period
which starts on the day contract is made and ends on the
expiry of 7 working days starting from the day after the
goods have been received. During this time you may exercise
their right to cancel the contract in respect of certain
goods and services. This does not apply to business to business
transactions, nor does it apply to certain products which
we supply including, but not limited to computer software
which has been unsealed, systems assembled on the customers
behalf from components or any items "custom built" for
the customer. Should you wish to exercise your right of cancellation
you must either return the goods to us or allow us to pick
up the goods, in which case the full cost of collection will
be deducted from your refund. Any refund due under these
provisions will be made to you within 30 days of such cancellation
